Smith Act, 1940
   The Alien Registration Act of 1940, known as the Smith Act, made it illegal to advocate, teach, or organize the overthrow of any government in the United States by force or violence or to disseminate material calling for such action. It also required all noncitizens to register with the government. The legislation was used in 1949 to prosecute a number of the leaders of the Communist Party of the United States of America. However the Supreme Court increasingly found such convictions unconstitutional, and by the late 1950s the act was more or less inoperative, although it remains on the statute books.
